TERMS & CONDITIONS:

1. These terms and conditions apply in every contract for the supply of goods by Epic Stone Pty Ltd.

2. Standard stocks can be kept on hold free of charge for up to two working days. 50% deposit must be paid when stocks are still required to be kept on hold after the second working day.

3. On hold orders need to be collected or delivered from Epic Stone’s warehouse within 14 days after the deposit is made, otherwise the order will be automatically regarded as cancelled. Alternatively, to extend the holding period, the remaining balance of the orders must be paid in full.

4. Deposit is non-refundable nor transferable if the on hold orders are cancelled.

5. 50% deposits must be paid in advance of production for any special orders. The remaining balance must be paid when stock arrives in Epic Stone’s warehouse. Once production is commenced such deposits are non refundable and orders must be paid for in full.

6. Epic Stone will endeavour to make best efforts at all times and on arrival and availability dates, but will not be held responsible for any delays beyond our direct control.

7. Epic Stone reserves the right to cancel any order we are unable to fulfil.

8. By receiving an invoice, it is agreed, understood and accepted that all natural stone products are products of nature and is subject to natural characteristics, colour variation and appearance. Consequently, up to 5% breakage, chips and hair line cracks is allowed due to the nature of the stone. 

9. Clients review and approval of goods prior to delivery is recommended.

10. Product suitability. It is the responsibility of Customer to ensure that any product selected is suitable for its intended application. It is the Customer’s responsibility to ensure that adequate stock is purchased to complete a job, as matching shades and batches of product cannot be guaranteed for subsequent orders.

11. Product must be laid in accordance with applicable industry standards. It is the fixers’ duty to lay the material under control of the client or the client’s agent. Note that the blending of tiles or pavers from different pallets/crates is standard practice in managing colour variation.

12. To protect natural stone, sealing is recommended.

13. Epic Stone does not accept returns for any unused tiles or change of mind.

14. Epic Stone acknowledges that the Buyer may collect purchased goods from Epic Stone's warehouse. Epic Stone will not be liable in any way whatsoever for any damage that may be caused as a result of, but not limited to, excessive weight of the goods, improper weight distribution of the goods and goods that are not stored correctly for transport.

15. The Buyer accepts that all imported goods are subject to availability and that there may be delays from time to time. Where practicable, Epic Stone will seek to act in good faith and notify the Buyer of any such delays in a timely manner. Epic Stone will not be liable for any costs incurred in relation to any such delay. 

16. Epic Stone may in its sole discretion decide that goods will not be available for collection until funds have cleared in our bank accounts. 

17. Delivery of the goods is deemed effective once the goods have been made available for unloading at the nominated delivery point. Epic Stone will deliver to an external point with easy access. Epic Stone will not enter any premises or carry the goods further than external delivery point.

18. Under no circumstances shall the Buyer have any claim of any nature whatsoever arising from late delivery.

19. A minimum of 48 hours turnaround time is to be given for goods being collected. Epic Stone reserves the right to refuse dispatch of goods for any unscheduled attempts to collect goods.

20. In the case of the Buyer collecting goods, the goods are deemed to be delivered once loaded onto the Buyers vehicle or arranged transport.

21. Insurance of goods in transit is the responsibility of the customer whether transport is organised by the customer or by Epic Stone on behalf of the client.

22. The Buyer will accept the goods upon delivery and goods must be inspected for any damages or defective product. If the customer uses the goods in any way beyond the initial receipt, it shall be deemed to that the goods conform to the relevant order and are fit for the purpose for which they are intended.

23. Any damages must be reported to Epic Stone within 48 hours of receiving goods and any returns must be delivered back to Epic Stone within 7 days of purchase in the same condition as received, with original packaging. Should the returned goods condition differ, Epic Stone reserves the right not to accept the return. All claims not made within 48 hours are deemed to have been waived.

24. By receiving an invoice it is agreed, understood and accepted that Epic Stone will not accept any liability for goods that have been installed and that the goods are sold without any warranties. No claims will be accepted after installation. 

25. The Buyer hereby indemnifies Epic Stone against any claim or liability of any nature whatsoever.

26. Epic Stone will only negotiate holding goods on the Buyers behalf if the goods are paid for in full. Epic Stone may agree to store goods on the Buyer’s behalf for a limited period if storage space is available. Such goods will be held at The Buyers risk and Epic Stone accepts no liability for loss or damage. Charges will apply if goods are not collected within 30 days.

27. Where Epic Stone accepts returns, a 30% handling fee will be applied to the total invoice value. No claims will be accepted once the material is laid. Claims of credit for return of goods can only accepted if it is current stock, in full crates or pallets and in good condition when returned. No loose crates and pallets will be accepted. No returns will be accepted after 7 days of pick up or delivery. Transport for return of goods is to be organised and paid for by the customer.

28. Should there be any disputes between the Buyer and Epic Stone in respect of the nature, quality, or quantity of any goods supplied or services rendered, Epic Stone’s rights to receive payment from the Buyer will not be affected in any way whatsoever, nor will it give anyone the right to set-off or counterclaim against.

29. By receiving an invoice the Buyer confirms information about Epic Stone’s products has been presented, fully explained, understood and accepted by him or her.
